Yeah I think so too. In the bug history of Chrome I saw a similar bug and they fixed it. Hopefully Safari will fix it as well.

You can't.. Use a dataview with dataitems instead.

And what if the panel already exists? When you pass an object (with the title) into setActiveItem() the content of the navigation panel doesn't refresh.
