I’m a bit confused on the rules.
I see at the beginning a passage that reads “IF SELECTED AS A PRIZEWINNER IN THIS CONTEST, THE PRIZEWINNER WILL GRANT SENCHA THE RIGHT (FREE OF CHARGE OTHER THAN THE PRIZE) TO USE, ALTER, MODIFY, AND DISTRIBUTE THE THEME, AS MORE PARTICULARLY SET OUT BELOW.”
Later, in a section titled “LICENSE TO PRIZEWINNER’S THEME”, there is a passage that seems to contradict this. It reads, “By submitting and Entry, each Entrant (if the Entrant is a Team, this shall refer to each individual member of such Team holding intellectual property rights in the Entry) grants to the Sponsor (and their agents, successors, and assigns) the irrevocable, transferable, sublicensable, absolute right and permission… “.
So at the beginning the rules claim that only the winners will be granting rights to the Sponsor, but later on it says that all entrants will implicitly grant rights. So, which one is it?
Yes, this should only be the winners who grant rights to their themes. We will update the contest rules to limit the grant to Prizewinners instead of Entrants.
